ITALY IN MY POCKET | TERMS AND CONDITIONS

We are delighted that you have chosen to join us on one of our captivating small group journeys, exploring the wonders of Umbria with Italy In My Pocket. Please take a moment to carefully review the following Terms and Conditions, which have been tailored to ensure your seamless and enjoyable journey with us.

Italy in My Pocket (ABN 88 607 857 781) manages all bookings. These Terms and Conditions, together with the Booking Confirmation Form, form the agreement between the guest and Italy in My Pocket. By signing the Booking Confirmation Form and paying the required deposit, the guest confirms that they have received, read, understood and accepted these Terms and Conditions.

PLANNING YOUR JOURNEY

  • Journeys are subject to a minimum number of confirmed guests. We will notify guests in writing whether the journey will proceed no later than three months before departure.
  • If Italy in My Pocket cancels a journey because the minimum number of guests has not been reached, all payments made to Italy in My Pocket will be refunded. Alternatively, guests may choose to transfer their payments to another available journey.
  • Our scheduled small-group journeys are designed primarily for adults. For private family journeys, we warmly welcome younger guests and will consider their ages, interests and individual needs when planning the itinerary. Families are encouraged to discuss these details with Italy in My Pocket before confirming their booking so that we can ensure the proposed journey is suitable for everyone.
  • Guests should delay making flight reservations until written confirmation that the journey will proceed has been received from Italy in My Pocket. Any travel arrangements made before written confirmation are made at the guest’s own risk and cannot be reimbursed by Italy in My Pocket.
  • For any extended duration in the destination beyond the scheduled journey dates, you will be responsible for the associated costs.
  • Verify that your passport remains valid for at least three months beyond your departure from Italy, following the stipulations of the Italian government. We advise reviewing and renewing your passport, if necessary, with a six-month recommended validity period.
  • Take responsibility for and cover the expenses associated with meeting visa requirements for entry into Italy. Consult the Italian government website for comprehensive details. Thoroughly research and comply with the visa and passport prerequisites for Italy, as no refunds can be issued in case of entry denial, even if visa support has been furnished.
  • For journeys priced in a currency other than Australian dollars, currency fluctuations may affect the converted value. Payments remain due in the currency specified in the Booking Confirmation Form.


PAYMENTS

A 30% deposit is required to secure your booking. A further 30% instalment and the final 40% balance are payable on the dates specified in your Booking Confirmation Form. The final balance must be paid no later than two months before the journey begins.

Payments are to be made by bank transfer using the account details provided by Italy in My Pocket. International guests may be provided with local-currency bank payment details where available. Any alternative payment arrangements must be agreed with Italy in My Pocket in advance.

CANCELLATION AND REFUND

Cancellations by a guest must be submitted in writing to maria@italyinmypocket.com. The applicable refund will be determined according to the date written notice is received by Italy in My Pocket:

  • 120 days or more before journey commencement: full refund of payments made.
  • Between 119 and 61 days before journey commencement: refund of 50% of payments made.
  • Within 60 days of journey commencement: no refund.

No reimbursements or credits will be provided for non-attendance, late arrival, early departure or any portion of the journey a guest chooses not to use, including accommodation, meals, activities and other included services. Guests arriving after the designated commencement time are responsible for any costs incurred in reaching the group. arising from a guest’s inability to attend due to illness, flight disruption, personal circumstances or other events affecting their individual arrangements remain subject to these conditions. Guests should seek reimbursement through their travel insurer where applicable.

TRAVEL INSURANCE

Comprehensive travel insurance is compulsory for all guests and should be obtained as soon as possible after booking. Travel insurance should provide appropriate cover for the guest’s individual circumstances, including journey cancellation, medical expenses, emergency assistance and repatriation, personal belongings, travel delays and other unforeseen circumstances. Guests must provide Italy in My Pocket with a copy of their Certificate of Insurance before departure.

Guests are responsible for selecting a policy appropriate to their individual circumstances and for understanding its inclusions, exclusions and limitations. Italy in My Pocket is not responsible for determining the suitability or adequacy of a guest’s insurance policy, or for losses, expenses or liabilities arising from insufficient or inappropriate insurance cover.

VIDEOGRAPHY AND PHOTOGRAPHY

During our journeys, we capture memorable moments through photos and videos that may be used for future promotional materials, including social media platforms and our website. If you prefer not to be included in these promotional materials, please inform us in advance by sending an email to maria@italyinmypocket.com. Your privacy and preferences are important to us, and we respect your choice to opt out of being featured in our promotional content.

ACCOMMODATION

Journey prices are based on the occupancy arrangement specified in the Booking Confirmation Form. Double occupancy is based on two guests sharing one room. Bedding configurations vary between properties and may include one double bed or separate beds. Requests for separate beds will be accommodated where available but cannot be guaranteed. Solo occupancy provides one guest with a private room and is charged at the applicable solo-occupancy price.

DIETARY REQUIREMENTS

We make every reasonable effort to accommodate dietary requirements and food allergies notified to us before departure. However, our journeys are designed to celebrate Italian food culture, and guests with extensive or highly specialised dietary requirements may encounter limitations.

Dietary requirements and allergies are communicated to our accommodation providers, restaurants and local partners, but Italy in My Pocket cannot guarantee a completely allergen-free environment or the absence of cross-contamination.

Guests remain responsible for discussing serious allergies directly with food-service providers when appropriate and for carrying any medication they may require.

Please inform Italy in My Pocket of all dietary requirements and food allergies at the time of booking and notify us promptly of any subsequent changes.

HEALTH AND FITNESS

Our journeys involve walking through historic Italian towns, including uneven surfaces, cobblestones, steps, slopes and areas with limited vehicle access. Guests should have a reasonable level of health, mobility and fitness to participate safely and comfortably. Guests must inform Italy in My Pocket at the time of booking of any medical condition, mobility requirement or other circumstance that may affect their participation. We will make reasonable efforts to accommodate individual needs where possible, but some locations, activities and historic properties may have limited accessibility.

Italy in My Pocket may request medical confirmation that a guest is fit to participate where reasonably necessary. If a guest requires assistance beyond what Italy in My Pocket and its local partners can reasonably provide, we will discuss the available options with the guest before the journey. Guests are responsible for carrying any required medication and ensuring that their travel insurance provides appropriate medical and cancellation cover.

ACCEPTANCE OF RISK

Guests acknowledge that travel may involve risks beyond those ordinarily encountered in daily life. These may include uneven terrain, changing weather conditions, transportation, unfamiliar environments and participation in cultural, culinary and outdoor activities. Guests participate voluntarily and are responsible for acting with reasonable care, following safety instructions and considering their own health, mobility and personal circumstances.

Italy in My Pocket will take reasonable care in arranging and delivering the journey. Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

LAWS AND RESPONSIBILITIES

Guests must comply with applicable Italian laws, public-health requirements and reasonable safety instructions provided by Italy in My Pocket, the journey host and local partners.

Illegal drug use is prohibited. Guests are expected to consume alcohol responsibly and comply with all smoking restrictions applying to accommodation, transportation, restaurants and other venues included in the journey.

Italy in My Pocket may require a guest to leave the journey if, in our reasonable opinion, their behaviour is unlawful, unsafe, seriously disruptive or places another person’s safety or wellbeing at risk. In these circumstances, no refund will be provided for unused services, and the guest will be responsible for any additional accommodation, transportation or other costs resulting from their removal from the journey.

FORCE MAJEURE

A force majeure event is an event beyond the reasonable control of Italy in My Pocket, including natural disasters, severe weather, fire, flood, epidemic or pandemic, war, civil unrest, government restrictions, border closures, industrial action or significant disruption to transportation or essential services.

If a force majeure event prevents or materially affects Italy in My Pocket’s ability to deliver a journey, we may need to alter, postpone or cancel the journey. We will notify affected guests as soon as reasonably practicable and take reasonable steps to minimise the impact.

Where Italy in My Pocket is unable to deliver the journey, guests will be entitled to a refund of payments made to Italy in My Pocket, less any reasonable and unrecoverable costs already incurred in arranging the journey, where permitted by law. Alternatively, guests may choose to transfer any available payments to another journey.

If the journey remains able to proceed but a guest is unable to attend because of cancelled or disrupted flights, border restrictions, personal circumstances or other events affecting their individual travel arrangements, the guest’s cancellation will be subject to the Cancellation and Refund conditions. Italy in My Pocket is not responsible for flights or other travel arrangements booked independently by the guest. Guests should seek reimbursement from the relevant supplier or travel insurer.

Italy in My Pocket is not responsible for additional costs incurred by guests as a result of a force majeure event, including flights, accommodation or other independent travel arrangements. Guests should ensure their travel insurance provides appropriate cover for these circumstances.

Nothing in this section excludes any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

CLAIMS AND CONCERNS

If an issue arises during a journey, guests should notify the journey host as soon as reasonably possible so that we have an opportunity to assist and seek an appropriate solution.

Any unresolved concern or claim should be submitted in writing to maria@italyinmypocket.com, together with relevant details and supporting documentation.

LIABILITY AND GOVERNING LAW

Italy in My Pocket works with independent accommodation providers, transportation providers, restaurants, artisans, guides and other local partners in delivering its journeys. While we take reasonable care in selecting and coordinating these providers, we are not responsible for events or circumstances beyond our reasonable control.

Guests are responsible for their personal belongings and should ensure that their travel insurance provides appropriate cover for loss, theft or damage to baggage and other possessions.

Italy in My Pocket is not responsible for delays, alterations, losses or additional expenses arising from independently arranged flights, transportation, accommodation or other services that are not included in the journey.

These Terms and Conditions are governed by the laws of Victoria, Australia. If a dispute arises, the parties agree to first attempt to resolve it in good faith and may agree to participate in mediation before commencing legal proceedings. Any legal proceedings will be subject to the jurisdiction of the courts of Victoria, Australia.

All prices are accurate at the time they are quoted. The confirmed journey price and payment currency will be specified in the guest’s Booking Confirmation Form.

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
